PFAS Pitfalls Await Industry Brands as States Pass New Regulations
Rapidly evolving regulations on per- and polyfluoroalkyl substances (PFAS) present a minefield for industry brands, experts from the Buchalter law firm and science and engineering consultant Exponent explained at the SFIA’s “Navigating PFAS Regulations” webinar. Companies stating products are PFAS-free has become “pretty dangerous,” and they are advised to make sure in-house or third-party ad and marketing agencies are aware of ramifications. “Creative tie-ins” of ESG statements are making their way into filings, raising red flags on any environmental and sustainability statements that may contradict use of PFAS.
