Converse Wins Partial Victory on ITC Appeal

The Nike-owned brand saw the agency vacate an earlier remand initial determination that found that Converse’s Chuck Taylor marks had not acquired a secondary meaning, but it affirmed the determination that the only respondents still active—Skechers, New Balance and Highline United—had not infringed on them. The ruling found that Converse had established that its marks had secondary meaning, but failed to show a likelihood of confusion or injury to its domestic industry from the other companies’ accused products.
