Midsole Design Upheld for Converse All-Star


The U.S. federal court of appeals overruled the ITC on an earlier finding that the stripe on the All-Star midsole was not protectable. The ITC sided with Converse after it filed a complaint alleging 31 retailers and shoe designers were infringing on its mark, including New Balance and Skechers. The appeals court agreed that the stripe had acquired secondary meaning even before it was registered in 2013 because it had been in use since 1932.
