DE Court Denies Cabela’s Injunction for Highby Outdoors


The federal district court ruled that the non-compete agreements that employees signed to get stock as employees and severance after the Bass Pro merger were unenforceable because they had the effect of preventing competition in violation of NE state law rather than protecting legitimate confidential information. It did agree with Cabela’s claim that Highby most likely misappropriated some confidential information involving sales projections, but noted that the impact of that was minimal and would decline over time.
