Key Ruling on Outlet Pricing Hits Nike Defense


The Ninth Circuit in CA reversed a lower court ruling involving Neiman Marcus, holding that it is a matter for a jury to decide whether Suggested Retail Price is deceptive and further found that, at the initial stages of litigation, plaintiffs cannot be expected to know about a company’s internal pricing practices and discovery should proceed. The Eager Bevaertons fought vigorously to get Monika Taylor vs. Nike thrown out on summary judgment, arguing that Suggested Retail Price does not imply that an item was actually sold at that price.
